Seller Agreement

1. The agreement
This agreement is between Bolrach Technologies Limited, which runs FirstBy, and the business or person who opens a store on FirstBy. It applies alongside the Terms of Use, Prohibited Items and Acceptable Use. You sell to shoppers in your own name: each sale is a contract between your store and the shopper, and FirstBy runs the checkout and holds the payment.
2. Verification before you sell
You can set up your store and write listings straight away. Nothing goes on sale and nothing is paid out until your store is verified, through Authvio or by documents our team reviews. If a verification document expires or is withdrawn, your listings come off sale and payouts pause until it is renewed. Listings you asked to put on sale go back on by themselves once verification passes.
3. Listings
- Describe each item accurately, with your own photos or ones you have the right to use.
- Set a price that includes everything except delivery and sales tax, which checkout adds.
- Keep stock accurate, and ship within the handling time you state.
- Do not call your store or items "verified", "official" or similar unless FirstBy has awarded the badge.
4. Returns and cases
You offer at least 30 days for returns. You choose who pays for a change-of-mind return and whether to keep a restocking fee, up to 20% of the price; both show on your listings, and a sale keeps the terms it was made under. When an item arrives damaged, wrong or not as described, you pay for the return label and keep no fee. When a shopper opens a case, you have 3 days to answer before FirstBy decides it, and a decision for the shopper is refunded from your earnings.
5. Money
- FirstBy takes the commission and fees shown in your seller console at the time of each sale. Changes apply only to sales made after we give you 30 days' notice.
- You earn a sale when it is delivered. Earnings on lines with an open case are held until the case is decided, and refunds come out of your earnings.
- Payouts go to the bank account registered for your store, and only while your store is verified.
- Where the law makes FirstBy responsible for collecting sales tax on your sales, we charge and remit it. You remain responsible for your own income tax and for any other tax registration your business needs.
6. Shoppers' information
You receive a shopper's name, address and phone number only to deliver their order and handle its return. Do not use them for anything else, keep them secure, and delete them when you no longer need them.
7. Suspension and closing
We may take a listing off sale, or suspend your selling, when you break this agreement, when a rights complaint is upheld against you more than once, or to prevent fraud. We will tell you why and how to ask for a review. While selling is suspended, you still ship orders already placed, handle their returns, and are paid what you have earned. Either of us may end this agreement with 30 days' notice, or at once for a serious breach.
8. Changes
We will give you at least 30 days' notice of a change to this agreement, by email and in your seller console. If you do not accept it, you may close your store before it takes effect.
