Terms of Use

These documents cover orders delivered in Canada. FirstBy does not take orders for United States yet, so they do not apply there.
1. Who we are
FirstBy is an online marketplace and price-comparison service run by Bolrach Technologies Limited, a company based in Edmonton, Alberta, Canada ("FirstBy", "we", "us"). Independent stores list and sell their own products on FirstBy. When you buy, your contract of sale is with the store that sells the item; FirstBy runs the checkout, holds your payment until delivery and steps in when something goes wrong.
By creating an account, browsing or buying on FirstBy, you accept these terms and the policies they link to: the Privacy Policy, Returns & Refunds, Buyer Protection and Acceptable Use. Stores also accept the Seller Agreement.
2. Your account
You need to have reached the age of majority where you live to buy on FirstBy. Give us your real name, date of birth and a working email address, keep them current, and keep your sign-in details to yourself. You are responsible for what happens on your account until you tell us it has been compromised.
3. Prices, taxes and payment
- Each store sets its own prices, delivery charges and stock. A price can change until you place the order.
- Checkout shows the full amount before you pay: the items, delivery, and the sales tax of the province or territory you are shipping to.
- Where the law makes FirstBy responsible for collecting sales tax on a sale through the marketplace, we charge it and pay it to the tax authority.
- Your payment is taken by our payment provider. FirstBy never sees or stores your full card number.
- An order is confirmed when payment is captured and you receive a confirmation.
4. Delivery
Each store ships its own items, so an order from several stores can arrive in several parcels. The order page shows the carrier, tracking and expected dates the store gives us. Risk in an item passes to you on delivery.
5. Returns, refunds and problems
You can return most items for at least 30 days after delivery, on the terms shown on each listing before you buy. If an item does not arrive, arrives damaged, or is not what the listing described, the return is free and FirstBy can decide the case if the store does not put it right. 6. Reviews and what you post
Reviews, questions, answers and messages you post must be honest and your own. You keep ownership of what you write, and you give FirstBy a licence to show it on the service. We may remove anything that breaks Acceptable Use, and a removed review stops counting towards a store's rating.
7. What you may not do
Do not use FirstBy for fraud, to sell or buy anything on the Prohibited Items list, to copy the site with automated tools, or to interfere with how it runs. We can restrict or close an account that does, and we will tell you why unless the law or an investigation prevents it.
8. Our responsibility to you
We run FirstBy with reasonable care and skill. We are not the seller of items listed by stores, and we do not promise the site will never be interrupted. Nothing in these terms removes or limits a right you have under the consumer protection law of your province or territory, including the Quebec Consumer Protection Act if you live in Quebec. Where the law allows us to limit our liability, it is limited to the amount you paid for the order concerned.
9. Law and disputes
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there, except that a consumer keeps the protection of the laws of the province or territory where they live and may bring a claim in its courts. Please contact us first through the Help Center; most problems are solved there.
10. Changes to these terms
When we change these terms in a way that matters to you, we will tell you on the site and by email at least 30 days before the change takes effect, and show what changed. Orders placed before then stay under the terms you accepted when you placed them. If you do not accept a change, you can close your account at any time.
